Ellicott Woman Pleads Guilty to Throwing Tobi the Cat to Her Dogs; Deal Seeks No Prison
COLORADO SPRINGS, Colo. (Oct. 9, 2026) — Tobi, a cat who lived with a 15-year-old boy in Ellicott, was carried next door on June 3 and thrown to two dogs. Ashley Losey, the neighbor who took him, pleaded guilty to felony aggravated cruelty to animals on Oct. 7 under an agreement that calls for no prison time.

Losey, of Ellicott, admitted one count of aggravated cruelty to animals, a class 4 felony, according to the plea agreement filed in El Paso County District Court. Under the agreement she would serve three years of probation, complete 75 hours of public service, pay a $500 fine and serve 30 days in jail, suspended if she meets every condition. She would surrender the animals in her possession to the Humane Society of the Pikes Peak Region and be barred from owning animals for the length of her sentence. She would serve no prison time, and the court has not yet accepted the agreement.
Losey was charged in June with six counts: aggravated cruelty to animals, tampering with evidence, two counts of ownership of a dangerous dog and two counts of child abuse with no injury, KRDO13 reported. She has admitted the cruelty count, and the district attorney will move to dismiss the other five.
Tobi’s family had installed security cameras because of a years-long dispute with the neighboring household. The footage shows Losey picking up Tobi, carrying him into her home and throwing him out the back door into her yard, where her dogs attacked him, according to arrest records obtained by KRDO13.
Aggravated cruelty to animals carries two to six years in prison in Colorado. District Court Judge Laura N. Findorff is scheduled to sentence Losey on Nov. 18. Findorff is not bound by the agreement and can reject it.
“Three years of probation and a $500 fine is what this deal says Tobi’s life is worth,” said In Defense of Animals Senior Campaigner Doll Stanley. “Tobi was a member of a family. We are asking Judge Findorff to reject this deal on Nov. 18.”
In Defense of Animals launched a petition in July and delivered 14,623 signatures and a letter to District Attorney Michael J. Allen, asking his office to seek the maximum penalty and not to offer a plea agreement. The office offered one anyway.
“Tobi’s family will live with this for the rest of their lives,” Stanley said. “There is no probationary period for grief.”
